Affidavit

I, Ms. Neha Sharma, D/o Mr. Rajesh Sharma, Hindu, aged about 32 years, Private Employee, residing at 45, Rajouri Garden, New Delhi, do hereby solemnly affirm and state as follows:

  1. I am the defendant in the above suit and the petitioner herein. I am well acquainted with the facts of the case.
  2. I had filed an application to set aside the ex parte decree, in I.A. No. 18/2025, and the Hon’ble Court was pleased to allow the said application subject to a conditional order directing me to deposit Rs. 5,000/- on or before 25th May 2025, failing which the petition would stand dismissed.
  3. Unfortunately, about four days prior to the deadline, I was involved in an accident and had to be admitted to CityCare Hospital, New Delhi. I was confined to bed and unable to take any steps to comply with the court’s direction.
  4. I was discharged yesterday, i.e., on 5th June 2025, and I am now in a position to deposit the said amount of Rs. 5,000/- as directed by the Court. I am enclosing the medical certificate issued by the attending physician as proof of my bonafides.
  5. The delay was purely due to unavoidable medical reasons, and there is neither negligence nor laches on my part.
  6. I therefore respectfully pray that this Hon’ble Court may be pleased to enlarge the time granted under the conditional order, and permit me to deposit the sum of Rs. 5,000/- towards costs, in the interest of justice. Otherwise, I will suffer grave and irreparable loss.
