For the reasons stated in the accompanying affidavit, the petitioner respectfully prays that this Hon’ble Court may be pleased to order service of summons to the respondent/defendant by way of publication in any local newspaper having circulation in the area where the defendant was last known to reside, and to pass such other order or orders as this Hon’ble Court may deem fit and proper in the interest of justice.

I, Arjun Kumar, S/o Ramesh Kumar, Hindu, aged about 35 years, Occupation: Businessman, residing at 123, Green Park, New Delhi, do hereby solemnly affirm and state on oath as follows:

  1. I am the plaintiff in the above suit and the petitioner herein. I am well acquainted with the facts and circumstances of the case.
  2. I respectfully submit that the summons issued by this Hon’ble Court to the defendant/respondent Neha Sharma have been repeatedly returned unserved. It is evident that the defendant is evading service of summons willfully, in order to gain undue time and delay the proceedings of this Hon’ble Court.
  3. In spite of several attempts through ordinary and registered service, the defendant has deliberately avoided receiving the court summons.
  4. Therefore, in the interest of justice and to proceed with the case fairly, I humbly request this Hon’ble Court to permit service of summons to the defendant by way of substituted service through publication in any local newspaper, preferably one with wide circulation in New Delhi.
  5. If this prayer is not allowed, I will be subjected to undue delay and irreparable loss, and the defendant will continue to obstruct the course of justice.
