For the reasons stated in the accompanying affidavit, the petitioner respectfully prays that this Hon’ble Court may be pleased to direct the respondent/plaintiff to allow the petitioner/defendant, along with his advocate, to inspect the following documents in the respondent/plaintiff’s Auditor’s Office, i.e., Sri V. Srinivasulu, Chartered Accountant, Office situated at Flat No. 305, 3rd Floor, Krishna Chambers, Connaught Place, New Delhi, and to pass such other orders as this Hon’ble Court deems fit and proper in the circumstances and in the interest of justice.

I, Arjun Kumar, S/o Ramesh Kumar, Hindu, aged about 35 years, Businessman, residing at 123, Green Park, New Delhi, do hereby solemnly affirm and state on oath as follows:
- I am the defendant in the above suit and the petitioner herein. I am well acquainted with the facts of the case.
- The plaintiff has filed the suit against me for rendition of accounts and other reliefs. The written statement filed by me may be treated as part and parcel of this affidavit.
- I respectfully submit that the plaintiff has been managing the entire accounts of the firm, including maintaining the day books and ledgers. Contrary to her claim in the suit, I have not been involved in handling or maintaining any such documents.
- In order to substantiate my contention that the plaintiff is solely responsible for maintaining the accounts, I seek permission to inspect the following documents that are in the custody of the respondent/plaintiff’s auditor, Sri V. Srinivasulu, Chartered Accountant, at Flat No. 305, 3rd Floor, Krishna Chambers, Connaught Place, New Delhi.
List of Documents for Inspection
- Day books and ledgers pertaining to the years 2021–2024 of the respondent/plaintiff.
- Income tax return files pertaining to the years 2021–2024 of the respondent/plaintiff.
- The above documents are vital for establishing the truth in the matter. I assure the Hon’ble Court that there is no intention to harass the plaintiff, and the inspection will be carried out in a respectful and professional manner in the presence of my legal counsel.
Hence, I therefore pray that the Hon’ble Court may be pleased to direct the respondent/plaintiff to allow me and my advocate to inspect the above-mentioned documents in her auditor’s office, in the interest of justice.
Failing which, I will be put to irreparable loss and hardship.
