I, Arjun Kumar, S/o Ramesh Kumar, Hindu, aged about 35 years, Occupation: Businessman, residing at 123, Green Park, New Delhi, do hereby solemnly affirm and state on oath as follows:
- I am the plaintiff in the suit and the petitioner herein. I am well acquainted with the facts and circumstances of the case.
- I have filed the present suit for a declaration that the pathway marked as A, B, C, D in the plaint plan is a joint pathway.
- The respondent/defendant has filed a written statement denying the said fact.
- Earlier, one Sri. [Name not specified] had filed a suit against the same respondent/defendant for injunction and other reliefs, which was registered as O.S. No. 1010/2023 on the file of District Court, New Delhi.
- In that suit, the respondent/defendant had stated in the written statement that the said pathway is indeed a joint pathway.
- In order to prove the said admission and for just adjudication of this case, it is essential to summon and examine the written statement filed by the respondent/defendant in O.S. No. 1010/2023 from the record room of the District Court, New Delhi.
Hence, I respectfully pray that this Hon’ble Court may be pleased to send for the written statement filed in O.S. No. 1010/2023 from the record room of District Court, New Delhi.
Otherwise, I will be put to irreparable loss and hardship.
