Petition filed on behalf of the petitioner/defendant under Or.20 R.11(2) and 151 of CPC.

For the reasons stated in the accompanying affidavit, the petitioner prays that the Hon’ble Court may be pleased to grant permission to pay the decretal amount in monthly installments of ₹1,000/- per month, and to pass such other orders as the Hon’ble Court deems fit and proper in the circumstances and in the interest of justice.

Affidavit

I, Neha Sharma, D/o Ramesh Kumar, Religion: Hindu, aged about 35 years, Occupation: Businesswoman, R/o 123, Green Park, New Delhi, do hereby solemnly affirm and state on oath as follows:

  1. I am the defendant in the suit and the petitioner herein, and I am well acquainted with the facts of the case.
  2. The Hon’ble Court has passed a decree in favour of the respondent/plaintiff directing me to pay the decretal amount with interest.
  3. I am liable to pay approximately ₹25,000/- to the plaintiff towards decretal amount, interest, and costs as per the decree.
  4. I run a small sundry shop and support my family with the limited income generated from the shop. I do not have any other income or property.
  5. Despite facing financial hardships, I am willing and committed to discharging the decretal amount sincerely.

Hence, I therefore pray that the Hon’ble Court may be pleased to grant me permission to pay the decretal amount in monthly installments of ₹1,000/-.

Else, I will be put to irreparable loss.
