Petition filed on behalf of the petitioner/ Plaintiff under Or.20 R.12(2) and 151 of CPC.

For the reasons stated in the accompanying affidavit, the petitioner prays that the Hon’ble Court may be pleased to pass a final decree for mesne profits for Rs. 25,000/- in accordance with the Commissioner Report in I.A. No. 22/2025, and to pass such other orders as the Hon’ble Court deems fit and proper in the circumstances and in the interest of justice.

Affidavit

I, Arjun Kumar, S/o Ramesh Kumar, Religion: Hindu, aged about 35 years, Occupation: Businessman, R/o 123, Green Park, New Delhi, do hereby solemnly affirm and state on oath as follows:

  1. I am the plaintiff in the suit and the petitioner herein, and I am well acquainted with the facts of the case.
  2. I filed the suit for recovery of possession and mesne profits from the date of the suit till the date of possession. The Hon’ble Court decreed the suit for possession and directed further enquiry regarding mesne profits.
  3. Subsequently, I filed an execution application to appoint an Advocate Commissioner, and he submitted his report in I.A. No. 22/2025.
  4. In accordance with the said report, the respondent/defendant is liable to pay Rs. 25,000/- towards mesne profits.

Hence, I therefore pray that the Hon’ble Court may be pleased to pass a final decree for mesne profits of Rs. 25,000/-, in the interest of justice.
Else, I will be put to irreparable loss.
