Petition filed on behalf of the petitioner/plaintiff under Order 1 Rule 10(2) CPC & Rule 28 of Civil Rules of Practice

For the reasons stated in the accompanying affidavit, the petitioner prays that this Hon’ble Court may be pleased to implead Rajesh Sharma, Kunal Sharma, and Vikas Sharma as defendants 2 to 4 in the above suit and consequentially amend the plaint as set out below, and to pass such other orders as the Hon’ble Court deems fit and proper in the circumstances and in the interest of justice.

Consequential Amendment:

  • To add respondents 2 to 4 as defendants 2 to 4 in the short and long cause title.
  • To insert para 3(b) after para 3(a), as follows: “The defendants 2 to 4 are also trying to interfere with the peaceful possession and enjoyment of the plaintiff. They are supporters and henchmen of the first defendant.”
  • To amend the word “defendant” as “defendants” wherever it occurs in the plaint.

I, Arjun Kumar, S/o Ramesh Kumar, Hindu, aged about 35 years, Businessman, residing at 123, Green Park, New Delhi, do hereby solemnly affirm and state on oath as follows:

  1. I am the plaintiff and petitioner in the above suit and am well acquainted with the facts of the case.
  2. I filed the suit against the first respondent/defendant for permanent injunction and other reliefs.
  3. This Hon’ble Court was pleased to grant interim injunction against the first defendant.
  4. During the pendency of the suit, the first defendant, having no other remedy, has set up respondents 2 to 4 — namely Rajesh Sharma, Kunal Sharma, and Vikas Sharma — as his supporters and henchmen, and they are now actively trying to interfere with my peaceful possession and enjoyment of the suit property.
  5. The proposed respondents are necessary and proper parties to the suit. Their presence is required to avoid multiplicity of proceedings and to ensure complete and effective adjudication of the matter.
  6. Hence, I pray that the Hon’ble Court may be pleased to implead Rajesh Sharma, Kunal Sharma, and Vikas Sharma as defendants 2 to 4 and allow consequential amendment of the plaint as set out in the petition.
  7. Otherwise, I will be put to irreparable loss and hardship.
