The petitioner respectfully submits that he filed the suit for partition of the plaint schedule property into two equal shares and allotment of one such share to the petitioner/plaintiff. The Hon’ble Court, after due trial, passed a preliminary decree on an earlier date (to be specified). In accordance with the said decree, the plaint schedule property is to be divided into two equal shares, with half to be allotted to the petitioner and the other half to the respondent.

In order to effectuate this division of property, it is just and necessary that an Advocate-Commissioner be appointed to partition the plaint schedule property by metes and bounds, and to ascertain mesne profits from the date of the suit until delivery of possession.

This petition being filed under Order 26 Rule 13 CPC for passing of the final decree, a fixed court fee of Rs. 2/- is paid herewith.

Therefore, the petitioner/plaintiff prays that this Hon’ble Court may be pleased to:

a) Appoint an Advocate-Commissioner to partition the plaint schedule property into two equal shares by metes and bounds;

b) Appoint the same Advocate-Commissioner to ascertain the mesne profits from the date of suit as per the preliminary decree;

c) Award costs of this petition; and

d) Grant such other reliefs as may be deemed just and proper in the circumstances of the case and in the interest of justice.
