  • Pass such other orders as the Hon’ble Court deems fit and proper in the circumstances and in the interest of justice.

Affidavit

I, Neha Sharma, W/o Ramesh Kumar, Religion: Hindu, aged about 35 years, Occupation: Businesswoman, residing at 123, Green Park, New Delhi, do hereby solemnly affirm and state as follows:

  1. I am the mother and natural guardian of the minor plaintiff in the suit and the petitioner herein. I am well acquainted with the facts of the case.
  2. I submit that the minor plaintiff has filed the suit for partition of the plaint schedule property into two equal shares and to allot one such share to the minor plaintiff by cancelling the sale deed executed by the first defendant in favour of the second defendant, which is alleged to deprive the minor of his rightful share.
  3. During the pendency of the suit, elders in the family have intervened and facilitated a settlement. As per the settlement, the second defendant has agreed to deposit ₹5,00,000/- (Rupees Five Lakhs only) towards the share of the minor plaintiff in a fixed deposit until the minor attains majority.
  4. The settlement also provides that I, as the guardian of the minor, am entitled to withdraw the annual interest accrued on the fixed deposit to meet the educational and maintenance expenses of the minor.
  5. I respectfully submit that the proposed settlement is highly beneficial and in the best interest of the minor plaintiff.

Hence, I pray that the Hon’ble Court may be pleased to:

  • Grant leave to settle the matter on behalf of the minor before the Lok Adalat as per the terms mentioned above, and
  • Pass such other orders as this Hon’ble Court may deem fit and proper in the interest of justice.
