Petition filed on behalf of the petitioner/Plaintiff under Or. 32 R. 11 and 151 of CPC.

For the reasons stated in the accompanying affidavit, the petitioner respectfully prays that this Hon’ble Court may be pleased to:

  • Declare the petitioner as major, and
  • Discharge or remove the guardian appointed earlier in the suit, and
  • Pass such other orders as this Hon’ble Court deems fit and proper in the circumstances and in the interest of justice.

Affidavit

I, Arjun Kumar, S/o Ramesh Kumar, Religion: Hindu, aged about 21 years, Occupation: Businessman, residing at 123, Green Park, New Delhi, do hereby solemnly affirm and state on oath as follows:

  1. I am the plaintiff in the suit and petitioner herein, and I am well acquainted with the facts of the case.
  2. My mother, Neha Sharma, had initially filed the present suit as my natural guardian, as I was a minor at the time of institution of the suit.
  3. I have now attained majority, having completed 21 years of age as per my date of birth certificate, which is being submitted herewith as proof.
  4. Since I am now a major, I am fully competent to conduct the suit on my own behalf, and hence I request the Hon’ble Court to discharge my mother as guardian and to declare me as major.
  5. I also request the Court to permit suitable amendment to the plaint, reflecting this change in status.

Hence, I respectfully pray that the Hon’ble Court may:

  • Declare me as a major,
  • Remove the guardian appointed earlier, and
  • Allow consequential amendments to the suit proceedings.

Else, I will be put to irreparable loss.
