Affidavit
I, Arjun Kumar, S/o Ramesh Kumar, Hindu, aged about 38 years, Occupation: Private Contractor, R/o Plot No. 50, Block-C, New Krishna Nagar, New Delhi-110051, do hereby solemnly affirm and state on oath as follows:
- I am the plaintiff in the suit and petitioner in the present application. I am well acquainted with the facts of the case and competent to swear to this affidavit.
- I have filed the above suit for permanent injunction restraining the defendant from interfering with my peaceful possession and enjoyment of the plaint schedule property. The contents of the affidavit filed in support of the application for temporary injunction may be read as part and parcel of this affidavit.
- I submit that the defendant/respondent, along with her men and supporters, is attempting to trespass upon the suit property forcefully, and unless this Hon’ble Court grants an interim injunction immediately, I will suffer irreparable harm and injury. The situation is urgent and does not permit delay. If notice is ordered prior to granting the interim relief, the very purpose of this application will be defeated, and the defendant may succeed in committing acts of trespass or cause damage that cannot be undone.
- I have a prima facie case, the balance of convenience is in my favour, and I will be put to irreparable loss and hardship if the injunction is not granted urgently without prior notice.
- Hence, I respectfully pray that this Hon’ble Court may be pleased to dispense with the notice under Order 39 Rule 3 CPC and grant interim injunction ex parte in my favour, in the interest of justice.
