The petitioner submits as follows:
For the reasons stated in the accompanying affidavit, the petitioner respectfully prays that this Hon’ble Court may be pleased to grant an interim injunction restraining the respondent/plaintiff, her agents, subordinates, and associates from interfering in any manner with the petitioner’s peaceful possession and enjoyment of the petition schedule property, and pass such other or further orders as this Hon’ble Court may deem fit and proper in the circumstances of the case and in the interest of justice.

I, Arjun Kumar, S/o Ramesh Kumar, Hindu, aged about 38 years, Occupation: Private Contractor, R/o Plot No. 50, Block-C, New Krishna Nagar, New Delhi-110051, do hereby solemnly affirm and state on oath as follows:
- I am the defendant in the above suit and the petitioner in this application, and I am well acquainted with the facts of the case.
- The plaintiff/respondent has filed the above suit for permanent injunction and also filed I.A. No. 25/2025 seeking interim injunction. The Hon’ble Court was pleased to order notice and I have filed my counter, and the said I.A. is now posted for hearing.
- However, in the meantime, the plaintiff/respondent has started interfering with my peaceful possession of the petition schedule property, despite not being in possession at the time of filing the suit. She is acting high-handedly and attempting to forcibly occupy a portion of the land under my possession, using local influence and with the help of certain outsiders.
- I submit that the suit filed by the plaintiff contains false, frivolous, and untenable allegations, and the plaintiff has no prima facie right or title over the petition schedule property. The counter affidavit filed by me in I.A. No. 25/2025 may be read as part and parcel of this affidavit.
- I have a prima facie case; the balance of convenience lies in my favour; and if the respondent/plaintiff is not restrained, I will suffer irreparable loss and injury, and the status quo will be disturbed before the matter is finally adjudicated.
- Hence, I respectfully pray that this Hon’ble Court may be pleased to grant an interim injunction restraining the plaintiff/respondent and her men, agents, and subordinates from interfering with my peaceful possession and enjoyment of the petition schedule property till the disposal of the suit, in the interest of justice.
Else, I will be put to irreparable loss.
