For the reasons stated in the accompanying affidavit the petitioner prays that the Hon’ble court may be pleased to decide the right, title or interest claimed by the second respondent/tenant in the E.P schedule property after issuing a notice to him and direct the petitioner to put in possession of the schedule property after removing the obstruction caused by the second respondent and his men, and to pass such other orders as the Hon’ble court deems fit and proper in the circumstances and in the interest of the justice.

Affidavit filed on behalf of the petitioner/DHR under Sec. 139 of CPC

I, ………………… S/W/o, ………….. Religion………………. aged about………… Occupation………… R/o……….do hereby solemnly affirm and state on oath as follows:

1. I am the DHR in the E.P. and petitioner herein, and I am well acquainted with the facts of the case.
2. I have filed the E.P for delivery of possession in pursuance of the decree and the Hon’ble court was pleased to issue a delivery warrant to Amin to deliver the petition schedule property to me. When myself and Amin went to E.P schedule property for delivery. The second respondent herein and his men obstructed the amin for delivery of the schedule mentioned property stating that he is having right over the schedule mentioned property and he resist the delivery of possession. Under these circumstance the Amin could not execute the delivery warrant and return the same that there is an obstruction by the second respondent.
3. Hence I therefore prays that the Hon’ble court may be pleased to issue notice to the second respondent on this application and make an enquiry into the right, title or interest of the second respondent herein in the E.P schedule property and issued a direction that I may be put in possession of the same after removing the obstruction or resistance at the hands of second respondent.

Else, I will be put to irreparable loss.
