This Agreement is made on this 1st day of July, 2025
Between
M/s Elegant Textiles Pvt. Ltd., a company registered under the Companies Act, 1956 and having its registered office at Plot No. 114, Industrial Area, Surat, Gujarat (hereinafter called “the Company”)
AND
Shri Ramesh Kumar, S/o Shri Gopal Kumar, R/o B-42, Gandhi Nagar, Surat, Gujarat (hereinafter called “the Job Worker”)
NOW THIS AGREEMENT WITNESSES AS FOLLOWS:
- That the Company is a manufacturer of cloth and agrees to engage job workers for various works in connection with the production of cloth.
- That the Job Worker agrees to perform work for the Company under the terms and conditions mentioned hereunder: i) The Job Worker shall function as an independent contractor and shall not be deemed an employee of the Company under any circumstances. ii) The Company shall provide suitable premises and necessary utilities at its own expense for the Job Worker to carry out the work entrusted. iii) The Job Worker shall devote his full time and attention to the assignments and perform the work efficiently and in the interest of the Company. iv) The Job Worker shall be paid by the Company for the work done, in accordance with the Schedule of Payment annexed to this agreement, subject to certification of the work as satisfactory by the Managing Director of the Company. v) During the period of this agreement, the Job Worker shall not engage in or undertake any similar work for any other entity or individual. Similarly, the Company shall not engage any other Job Worker for similar work during the validity of this contract. vi) Either party may terminate this agreement by giving one month’s written notice. The agreement shall end after the expiry of such notice period, provided there are no outstanding dues or pending obligations at the time of termination. vii) In the event of any dispute arising out of or relating to this agreement, it shall be referred to Shri Vinod Sharma, S/o Shri Raghunath Sharma, R/o 12, Nehru Colony, Surat, Gujarat, who shall act as sole arbitrator. His decision shall be final and binding on both parties.
