This Agreement is entered into between ABC Engineering Corporation Ltd., having its registered office at Industrial Estate, Sector 12, Faridabad, Haryana (hereinafter called the “Corporation”), and the ABC Employees’ Union, having its office at B-24, Union Bhawan, Sector 12, Faridabad (hereinafter called the “Union”), on this 1st day of July, 2025 at Faridabad.
WHEREAS:
- The Union represents a substantial number of employees of the Corporation;
- Both parties are desirous of promoting harmonious relations, cooperation, and mutual understanding between management and employees;
- It is mutually agreed that the Union shall act as the collective bargaining agent for employees who are members of the Union.
NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS:
- That the Union shall be recognized as the sole and exclusive collective bargaining agency for all employees of the Corporation who are or shall become members of the Union for the purpose of collective bargaining on wages, hours of work, and other terms and conditions of employment.
- That the admission of any employee into the Union shall be a matter solely between the employee and the Union. The Corporation shall not interfere, influence, or intervene in matters related to Union membership.
- That the Corporation shall not discriminate against, coerce, or penalize any employee for being a member of the Union or for participating in Union activities in accordance with the applicable laws.
- That the Corporation shall provide reasonable facilities and time to the Union representatives during working hours, subject to operational convenience, for attending to Union matters with prior approval.
OTHER COVENANTS
- The Union agrees to represent the interests of all its members fairly and without discrimination, and to discourage and prevent any illegal activity that might disrupt the operations of the Corporation.
- That this Agreement shall remain in force for a period of two years from the date hereof, unless terminated earlier by either party by giving 90 days’ written notice to the other party.
