Affidavit

I, Rajesh Sharma, S/o Late Neeraj Sharma, Hindu, aged about 38 years, Occupation: Private Employee, R/o Plot No. 5, Rajendra Nagar, New Delhi, do hereby solemnly affirm and state on oath as follows:

  1. I am the petitioner herein and I am well acquainted with the facts of the case.
  2. I respectfully submit that the 1st respondent/plaintiff filed the above suit against the 2nd respondent/defendant for partition of plaint schedule properties (A & B) into two equal shares and to allot one share to the defendant.
  3. I further submit that earlier, the 2nd respondent/defendant borrowed a sum of Rs. 25,000/- from one Mukesh Verma and executed a promissory note. Upon failure to repay the debt, the said Mukesh Verma filed O.S. No. 805/2022 on the file of the District Court, New Delhi, and the suit was decreed on 12th March 2023.
  4. In pursuance of the decree, half share in Item A of the plaint schedule property was attached and brought to public auction. I participated in the auction conducted by the Hon’ble Court, and being the highest bidder, the property was knocked down in my favor for Rs. 40,000/-.
  5. I have paid the entire sale consideration and poundage, and the Hon’ble Court issued a Sale Certificate in my favor upon confirmation of the sale.
  6. As such, I now have a valid and legal right over half share in the plaint A schedule property, and I am a necessary and proper party to the suit for its effective adjudication. I am herewith filing the certified copy of the Sale Certificate for the kind perusal of this Hon’ble Court.
  7. Hence, I humbly request that I may be impleaded as the 2nd defendant in the suit and be permitted to contest the same on merits.

Else, I will be put to irreparable loss.
