I, Mr. Arjun Kumar, S/o Mr. Ramesh Kumar, Hindu, aged about 35 years, Businessman, residing at 123, Green Park, New Delhi, do hereby solemnly affirm and state as follows:
- I am the plaintiff in the above suit and the petitioner herein. I am well acquainted with the facts of the case.
- I filed the suit for recovery of a promissory note debt. The Hon’ble Court pronounced judgment in my favour and passed a decree directing the defendant to pay the suit amount with interest at 6% per annum from the date of suit till realisation.
- However, due to a clerical error at the time of drafting the decree, the words “from the date of decree” were incorrectly inserted instead of “from the date of suit” in Paragraph No. 4 of the decree.
- This error is purely clerical and unintentional, and does not reflect the true intention and finding of the Court as expressed in the judgment.
- Therefore, I respectfully pray that this Hon’ble Court may be pleased to amend the decree in accordance with the judgment by inserting the words “from the date of suit” in place of “from the date of decree”.
- If the present application is not allowed, I will suffer irreparable loss.
