The petitioner respectfully submits:
For the reasons stated in the accompanying affidavit, the petitioner prays that this Hon’ble Court may be pleased to stay the execution proceedings for a period of one month to enable the petitioner to obtain stay orders from the appellate court, and to pass such other orders as this Hon’ble Court deems fit and proper in the circumstances and in the interest of justice.

I, Arjun Kumar, S/o Ramesh Kumar, Hindu, aged about 35 years, Occupation: Businessman, residing at 123, Green Park, New Delhi, do hereby solemnly affirm and state on oath as follows:
- I am the Judgment Debtor in the Execution Petition and the petitioner herein, and I am well acquainted with the facts of the case.
- I submit that the Decree Holder has filed the above Execution Petition against me for recovery of the decree amount and prayed for my arrest. I have already filed a counter stating that I do not have the means to pay the decretal amount, and I am suffering from tuberculosis (T.B.). Hence, I submit that I am not liable to be arrested.
- The Hon’ble Court, however, has passed orders for my arrest on 3rd June 2025. I am intending to file an appeal before the appellate court challenging the said order. I have already applied for certified copies of the decree and the arrest order. For obtaining certified copies, preparing the appeal, and securing a stay order from the appellate court, I humbly request this Hon’ble Court to grant a stay on the execution proceedings for a period of one month.
- If the arrest warrant is executed in the meantime, I will suffer irreparable loss and hardship.
Hence, I humbly pray that this Hon’ble Court may be pleased to stay the execution proceedings for a period of one month to enable me to obtain stay orders from the appellate court.
Else, I will be put to irreparable loss.
