Petition filed on behalf of the petitioner/plaintiff under Or. 39 R. 1 and 151 of CPC.
The petitioner submits as follows:
The petitioner respectfully prays that this Hon’ble Court may be pleased to grant a temporary injunction restraining the respondent/defendant, her agents, men, followers, subordinates and henchmen from interfering with the peaceful possession and enjoyment of the plaint schedule property bearing Plot No. 48, Block-C, New Krishna Nagar, New Delhi-110051, by the petitioner/plaintiff, until the disposal of the suit.
The petitioner also prays this Hon’ble Court may pass such other appropriate and suitable orders as it deems fit and proper in the interest of justice.

I, Arjun Kumar, S/o Ramesh Kumar, Hindu, aged about 38 years, Occupation: Private Contractor, R/o Plot No. 50, Block-C, New Krishna Nagar, New Delhi-110051, do hereby solemnly affirm and state as follows:
- I am the plaintiff in the suit and petitioner in the above I.A., and I am well acquainted with the facts of the case.
- I have filed the suit for permanent injunction and other appropriate reliefs against the defendant for unlawfully interfering with my peaceful possession of the property described in the plaint schedule.
- On 10th June 2025, the defendant, along with her men and followers, attempted to trespass into the property bearing Plot No. 48, Block-C, New Krishna Nagar, which is in my absolute and peaceful possession. The said property is clearly demarcated in the site plan filed with the plaint as boundary points ABCD.
- The defendant, wielding influence and using hired antisocial elements, is attempting to dispossess me forcefully and unlawfully. I am unable to protect my rights and possession without the aid of this Hon’ble Court.
- I submit that I have a prima facie case, the balance of convenience is in my favour, and unless the defendant is restrained by way of an interim injunction, I will suffer irreparable injury and hardship.
- I am filing this petition without notice under Order 39 Rule 3 of CPC, as granting prior notice would defeat the very purpose of this application. The defendant may attempt to complete her unlawful acts if forewarned. I am also filing third-party affidavits from neighbours affirming my possession and describing the threatening conduct of the defendant.
- I therefore humbly pray that this Hon’ble Court may be pleased to pass an order of temporary injunction, restraining the defendant and her men, agents, henchmen and anyone acting under her direction from interfering with my peaceful possession and enjoyment of the plaint schedule property, pending final disposal of the suit.
