Affidavit
I, Arjun Kumar, S/o Ramesh Kumar, aged about 35 years, Hindu, by religion, Businessman by occupation, residing at 123, Green Park, New Delhi, do hereby solemnly affirm and state as follows:
- I am the Decree Holder (DHR) and petitioner herein, well acquainted with the facts of the case.
- I have filed the above Execution Petition for recovery of the mortgaged decretal amount from the respondent/JDR, Neha Sharma. The E.P. is now posted for the sale of the mortgaged property.
- I wish to participate in the auction of the said mortgaged property as per law, along with other eligible bidders.
- I respectfully submit that no harm or prejudice would be caused to the Judgment Debtor or any third party if I am allowed to participate in the auction, being the mortgagee.
- Hence, I am constrained to seek the leave of this Hon’ble Court under Order 21 Rule 72-A CPC to allow me to bid in the sale of the mortgaged property.
Therefore, I pray that this Hon’ble Court may be pleased to grant permission to the petitioner to participate in the auction along with other bidders, and pass such other reliefs as deemed fit and proper in the interest of justice.
Otherwise, I will be put to irreparable loss.
