Petition filed on behalf of the petitioner/defendant under Or. 41 R. 5(2) and 151 of CPC.

For the reasons stated in the accompanying affidavit, the petitioner prays that this Hon’ble Court may be pleased to stay the execution of the decree dated 28/05/2025 for a period of one month, and to pass such other orders as the Hon’ble Court deems fit and proper in the circumstances and in the interest of justice.

Affidavit

I, Arjun Kumar, S/o Ramesh Kumar, Hindu, aged about 35 years, Occupation: Businessman, R/o 123, Green Park, New Delhi, do hereby solemnly affirm and state on oath as follows:

  1. I am the defendant in the suit and petitioner herein, and I am well acquainted with the facts of the case.
  2. The respondent/plaintiff filed the suit for recovery of the suit pronote amount. I have already paid the entire amount on a daily installment basis. The plaintiff/respondent is a money lender who provided the amount with interest at the rate of 36% per annum and collected repayments on daily basis. I have filed Ex. B1, the pocketbook entries made by the respondent/plaintiff himself showing such payments.
  3. However, the Hon’ble Court passed a decree in favour of the respondent/plaintiff on 28/05/2025. I have already filed copy application under C.A. No. 112/2025 dated 03/06/2025 for certified copies of the judgment and decree. As of now, I have not received the copies.
  4. Meanwhile, the respondent/plaintiff has obtained a certified copy and is attempting to file Execution Proceedings. If the decree is executed before I receive the certified copies and approach the appellate court, I will suffer irreparable loss.
  5. Therefore, I respectfully request that this Hon’ble Court stay the execution of the decree dated 28/05/2025 for a period of one month, to enable me to obtain certified copies and prefer an appeal.

Else, I will be put to irreparable loss and hardship.
