The petitioner respectfully states that, for the reasons mentioned in the accompanying affidavit, it is just and necessary that this Hon’ble Court may be pleased to issue a precept to the Civil Judge Court at Ghaziabad, to cause attachment before judgment of the immovable property belonging to the respondent, situated at Plot No. 88, Vaishali Sector 4, Ghaziabad – 201010, and to pass such other orders as this Hon’ble Court may deem fit and proper in the circumstances and in the interest of justice.

I, Arjun Kumar, S/o Ramesh Kumar, Hindu, aged about 35 years, Businessman, residing at 123, Green Park, New Delhi – 110016, do hereby solemnly affirm and state on oath as follows:
- I am the plaintiff in the above suit and the petitioner herein. I am well acquainted with the facts of the case and competent to swear to this affidavit.
- I have filed the above suit for recovery of a sum of ₹7,50,000/- based on a suit promissory note executed by the defendant on 15.11.2022.
- The averments in the plaint may be read as part and parcel of this affidavit.
- I respectfully submit that the defendant is in possession of immovable property bearing Plot No. 88, Vaishali Sector 4, Ghaziabad – 201010, which falls within the territorial jurisdiction of the Civil Judge Court at Ghaziabad, Uttar Pradesh.
- I have credible information that the defendant is attempting to alienate the said property with the intention to defeat the decree that may be passed in my favour.
- Therefore, I humbly request that this Hon’ble Court be pleased to issue a precept under Section 46 of the CPC to the Hon’ble Civil Judge, Ghaziabad, to cause attachment before judgment of the aforementioned immovable property, as per the schedule annexed hereto.
- If the precept is not issued and the property is alienated, I will suffer irreparable loss and hardship.
Hence, I pray that this Hon’ble Court may be pleased to allow this application and pass such other orders as may be deemed just and necessary.
