Affidavit filed on behalf of the petitioner/auction purchaser under Sec. 139 of CPC
I, ………………… S/W/o, ………….. Religion………………. aged about………… Occupation………… R/o……….do hereby solemnly affirm and state on oath as follows:
- I am the petitioner herein and auction purchaser in the E.P. and I am well acquainted with the facts of the case.
- I submit that I am the auction purchaser of the petition schedule house property. The Hon’ble court issued sale certificate in my favour. In pursuance of the said certificate I filed the application for delivery of the petition schedule property in the hands of the respondent/JDR. Myself and Amin went to the avoid delivery of the house i.e. petition schedule property, he locked the doors and went away. Hence the amin is unable to deliver the petition schedule house premises as the doors were locked.
- Hence I therefore pray that the hon’ble court may be pleased to order to break open the doors of the petition schedule premises to implement the delivery order.
Else, I will be put to irreparable loss.
