The petitioner respectfully submits as follows:
For the reasons stated in the accompanying affidavit, the petitioner prays that this Hon’ble Court may be pleased to:
- Direct the respondent/defendant to be detained in civil prison for a period of three months for wilful and deliberate disobedience of the injunction order passed by this Hon’ble Court in I.A. No. 25/2025 dated 14/05/2025, and
- Pass such other and further orders as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case and in the interest of justice.

Affidavit
I, Neha Sharma, W/o Amit Sharma, Hindu, aged about 35 years, Occupation: School Teacher, R/o House No. 21, Lane No. 3, Shakti Vihar, New Delhi – 110092, do hereby solemnly affirm and state as follows:
- I am the plaintiff in the suit and the petitioner herein, and I am well acquainted with the facts of the case.
- I filed the above suit seeking permanent injunction against the defendant from making illegal constructions, particularly a wall between points D and C as shown in the plaint plan. The Hon’ble Court was pleased to pass an interim injunction order in I.A. No. 25/2025 dated 14/05/2025, restraining the defendant from constructing the said wall.
- I submit that in wilful violation of the said injunction order, the defendant/respondent has proceeded to construct the wall along D-C despite the court’s restraint. The construction was carried out hurriedly at night between 8th and 10th June 2025, with complete disregard for the court’s directive. The conduct of the respondent is not only unlawful but is also a direct contempt of the orders of this Hon’ble Court.
- The action of the respondent amounts to wilful disobedience under Order 39 Rule 2-A CPC, and he is liable to be punished accordingly. I further state that unless appropriate punitive action is taken, the sanctity and authority of this Hon’ble Court will be undermined.
- Hence, I respectfully pray that this Hon’ble Court may be pleased to punish the respondent/defendant Arjun Kumar by detaining him in civil prison for a period of three months for disobedience of the injunction order passed in I.A. No. 25/2025 dated 14/05/2025 and pass such other order as may be deemed fit and proper.
Else, I will be put to irreparable loss and injury.
