Affidavit
I, Arjun Kumar, S/o Ramesh Kumar, Religion: Hindu, aged about 38 years, Occupation: Businessman, residing at C-21, South Extension, New Delhi, do hereby solemnly affirm and state as follows:
- I am the defendant in the above suit and the petitioner herein. I am well acquainted with the facts of the case.
- The plaintiff has filed the suit against me for recovery of the alleged pronote amount. The said pronote is a fabricated and forged document, created due to a personal misunderstanding between me and the plaintiff.
- The counter affidavit filed by me in I.A. No. 18 of 2025 (Petition for Attachment Before Judgment) may be read as part and parcel of this affidavit. At the time when the attachment order was passed, I was out of town and unaware of the proceedings, and therefore could not furnish any security earlier.
- I am now furnishing third-party security in compliance with the directions of this Hon’ble Court and to demonstrate my bona fides. The security offered is adequate and genuine.
- I therefore respectfully pray that the Hon’ble Court may be pleased to:
- Accept the third-party security furnished herewith; and
- Raise the attachment ordered before judgment.
Else, I will be put to serious and irreparable loss and hardship.
