I, Arjun Kumar, S/o Ramesh Kumar, Hindu, aged about 35 years, Occupation: Businessman, R/o 123, Green Park, New Delhi, do hereby solemnly affirm and state on oath as follows:
- I am the Judgment Debtor (JDR) in the above Execution Petition and the petitioner herein. I am well acquainted with the facts of the case.
- I submit that the Decree Holder (DHR) filed the present Execution Petition for recovery of the decretal amount. During the pendency of the E.P., elders intervened and facilitated an amicable settlement between me and the DHR.
- Pursuant to the said settlement, I paid a sum of Rs. [insert amount] to the respondent/DHR outside the court. The DHR issued a receipt on the same day and assured me that a satisfaction memo would be filed before this Hon’ble Court.
- However, till date, the DHR has not filed any such memo to record the satisfaction. I am, therefore, constrained to file this application along with a copy of the said receipt in support of my bona fides.
- I respectfully pray that this Hon’ble Court may be pleased to record the payment of Rs. [insert amount] as part/full satisfaction of the decree and pass appropriate orders in the interest of justice.
Failing which, I will suffer irreparable loss and hardship.
