Affidavit

I, Arjun Kumar, S/o Ramesh Kumar, Hindu, aged about 35 years, Occupation: Businessman, Residing at 123, Green Park, New Delhi – 110016, do hereby solemnly affirm and state as follows:

  1. I am the Judgment Debtor in the above-mentioned Execution Petition and the petitioner herein. I am fully acquainted with the facts of the case.
  2. The Decree Holder has initiated Execution Proceedings against me and has prayed for my arrest for non-payment of the decretal amount. Pursuant to the orders of this Hon’ble Court, I have been taken into custody and produced before this Court for committal to civil prison.
  3. I respectfully submit that I do not have the financial means to satisfy the decretal amount at this time. I intend to file an application under the Insolvency and Bankruptcy Code to be declared as an insolvent, and I undertake to do so within one month.
  4. I am prepared to furnish personal security to the satisfaction of this Hon’ble Court assuring my compliance and appearance.
  5. In these circumstances, I pray that this Hon’ble Court may kindly be pleased to release me from arrest and detention in civil prison.

Otherwise, I shall be put to grave hardship and irreparable loss.
