Affidavit filed on behalf of the petitioner/plaintiff under Sec. 139 of CPC

I, ___, S/W/o, ____, Religion ____, aged about ____, Occupation ____, R/o _____ do hereby solemnly affirm and state on oath as follows:

1. I am the plaintiff in the suit and petitioner herein, and I am well acquainted with the facts of the case.
2. I submit that I filed the suit on the basis of the suit contract of sale executed by the defendant in my favour on ………… the defendant filed the written statement with all false and frivolous allegations, alleging that the said contract of sale is a rank forgery. To prove my contention that the defendant himself got executed of sale, it is necessary to appoint the government Expert for comparisation of the signatures of the defendant in the suit contract of sale with the admitted signatures of the defendant. I am prepared to pay the necessary fees to the expert to give his opinion in that regard.
3. Hence I therefore pray that the Hon’ble court may be pleased to send the suit contract of sale to the Government expert for comparisation of the signatures of the petitioner with the admitted signatures and to file his report.

Else, I will be put to irreparable loss.
