For the reasons stated in the accompanying affidavit, the petitioner prays that this Hon’ble Court may be pleased to summon the Sub-Registrar, Guntur, to produce the T.I. Register relating to the sale deed dated 15th March 2019, executed by Late Rajeev Sharma S/o Mahendra Sharma, under Document No. 1423/2019, and to pass such other orders as this Hon’ble Court may deem fit and proper in the circumstances and in the interest of justice.

Affidavit

I, Arjun Kumar, S/o Ramesh Kumar, Religion: Hindu, aged about 35 years, Occupation: Businessman, residing at 123, Green Park, New Delhi, do hereby solemnly affirm and state as follows:

  1. I am the plaintiff in the suit and the petitioner herein, well acquainted with the facts of the case.
  2. I have filed this suit seeking specific performance of contract, allegedly executed by Late Rajeev Sharma, the father of the defendant. After his demise, the defendant is contesting the suit claiming that the agreement of sale is a forged document.
  3. However, I submit that the said Rajeev Sharma S/o Mahendra Sharma had earlier executed a sale deed dated 15th March 2019 in favor of one Mr. Dinesh Verma, which was duly registered before the Sub-Registrar, Guntur, under Document No. 1423/2019.
  4. In order to establish the genuineness of the agreement of sale and to enable comparison of the signatures of Late Rajeev Sharma in both the documents, it is essential to summon the T.I. Register maintained by the Sub-Registrar, Guntur.
  5. I undertake to produce or return the record if so directed by the Hon’ble Court.

Hence, I pray that this Hon’ble Court may be pleased to summon the Sub-Registrar, Guntur, to produce the T.I. Register with reference to the sale deed dated 15th March 2019, executed by Rajeev Sharma under Document No. 1423/2019, in the interest of justice.
Otherwise, I will be put to irreparable loss.
