This Sale Deed is made and executed on this 2nd day of June, 2025, at Allahabad by:
Sri Naseeruddin Khan, S/o Late Shri Moinuddin Khan, R/o House No. 42/3, G.T.B. Nagar, Kareli, Allahabad – 211016, acting in his individual capacity and as natural guardian of his minor sons Master Sameer Khan and Master Amaan Khan, both residing at the same address (hereinafter referred to as the Vendor),
IN FAVOUR OF:
Dr. Syed Haider Abbas, S/o Shri Syed Raza Abbas, Secretary/Manager of Unity Public School, Imamia Educational Society (Regd.), having his office at LandMark Consultancy Services, Lendi Baugh Complex, Near Sub-Registrar Office, Kurnool – 518003 (hereinafter referred to as the Purchaser).
WHEREAS:
- The Vendor and his two minor sons are joint owners and in possession of House No. 42/3, situated at G.T.B. Nagar, Kareli, Allahabad – 211016, inherited from Late Shri Moinuddin Khan, S/o Late Abdul Wahid Khan, R/o Allahabad, who had acquired the said property vide a registered sale deed dated 15th July 1975, registered at the Sub-Registrar Office, Allahabad as Document No. 9876, Book I, Volume 231, on pages 101 to 110.
- The said Late Shri Moinuddin Khan died intestate on 12th March 2005, upon which the property devolved upon his legal heirs, namely, his son Naseeruddin Khan and grandsons Sameer Khan and Amaan Khan.
- The Vendor is in urgent need of funds to meet certain pressing family necessities including educational expenses of his minor sons and has therefore decided to sell the said ancestral property.
- The Purchaser has agreed to purchase the aforesaid house for a total sale consideration of Rs. 65,00,000 (Rupees Sixty-Five Lakhs only).
NOW THIS SALE DEED WITNESSETH AS FOLLOWS:
That in pursuance of the above agreement and in consideration of the full and final amount of Rs. 65,00,000 (Rupees Sixty-Five Lakhs only) paid by the Purchaser to the Vendor (the receipt of which the Vendor hereby acknowledges), the Vendor, in his individual capacity, as Karta of the joint Hindu family, and as guardian of his minor sons, does hereby transfer, sell, and assign the entire rights, title, and interest in the said property to the Purchaser, to hold the same absolutely and forever.
The said property is being sold free from all encumbrances, charges, liens, and claims of any kind whatsoever.
The Vendor further covenants with the Purchaser as follows:
- That the Vendor has the full right and authority to sell the said property on behalf of himself and his minor sons in view of family necessity and benefit of the minors.
- That the Purchaser shall hold and enjoy the said property peacefully without any interruption or disturbance from the Vendor or any person claiming through or under him.
- That the Vendor and all persons lawfully claiming through him shall, at the request and cost of the Purchaser, execute any further deeds or assurances necessary to perfect the Purchaser’s title to the property.
- That the Vendor shall indemnify the Purchaser against all losses or legal consequences arising due to any future claims or defects in title.
DESCRIPTION OF THE PROPERTY
All that part and parcel of a double-storey, brick-built residential house bearing Municipal No. 42/3, situated at G.T.B. Nagar, Kareli, Allahabad – 211016, currently under tenancy of Sri Rajesh Kumar, S/o Ratan Lal, R/o Allahabad, at a monthly rent of Rs. 7,500/-, with the following boundaries:
- East: House of Mr. Ramesh Chandra
- West: Open Municipal land
- North: 20-feet wide Municipal Road
- South: Residential property of Mrs. Kavita Sharma
The house consists of a drawing room, 3 bedrooms, kitchen, bathrooms, open terrace, stairway, and parking space.
