This Deed of Sale is made on this 5th day of June, 2025 between:
Vendor:
Audit Karmachari Sahakari Avas Samiti Ltd., Mahalekhakar Karyalaya, Uttar Pradesh, Allahabad
(Registered under the U.P. Cooperative Societies Act, 1965, Reg. No. 3111 of 1968)
Through its Secretary Shri Shitla Prasad Pandey, S/o Shri Satya Narayan Pandey, R/o 750, Colonelganj, Allahabad.
(Hereinafter referred to as the “Vendor”)
AND
Vendee:
Shri Ravi Kumar, S/o Shri Ram Prasad, R/o 125, Civil Lines, Allahabad,
a bonafide member of the society since 1st August 2024, and having an annual family income not exceeding ₹18,000.
(Hereinafter referred to as the “Vendee”)
WHEREAS:
- Under a housing scheme, the U.P. Avas Evam Vikas Parishad, Lucknow (hereinafter called the Parishad) granted a lease to the Vendor Society for the plot through a registered lease deed dated 10th April 2020,
Document No.: 328/2020, Volume No. 45, Book No. 1, Page No. 82. - The lease deed provided:
- Lease term: 30 years with right to two renewals of 30 years each
- Initial rent: ₹1,200/year, payable by 1st April
- Use: Residential only; no subdivision or commercial use
- Transfer: Only with Parishad/Avas Ayukt approval
- Transfer Fee: 50% of market premium increase
- Building deadline: 5 years from allotment
- Subletting: Not allowed without permission
- Arrears Clause: All dues must be cleared before transfer
- The Parishad, through endorsement No. SPV/21/55-A/2025, gave approval to transfer the plot in favor of the Vendee.
- The Vendee has been a valid member of the society for more than 6 months, and is eligible under income criteria.
NOW THIS DEED WITNESSETH:
That in consideration of a sum of ₹75,000 (Seventy-Five Thousand Rupees only) already paid by the Vendee to the Vendor (the receipt of which is hereby acknowledged), the Vendor transfers all rights, title, and interest in the said plot of land described below:
TO HOLD
The said property to the Vendee for the unexpired lease term, subject to:
- Compliance with lease conditions,
- Payment of rent and taxes,
- Use for residential purposes only,
- No transfer or subletting without prior written consent from the Parishad.
INDEMNITY CLAUSE
The Vendor agrees to indemnify the Vendee against any claims, expenses, or proceedings that may arise due to breach of lease conditions, and the Vendee agrees to assume all rights and obligations under the lease henceforth.
