THIS INDENTURE is made on this 15th day of June, 2025 between THE ALLAHABAD DEVELOPMENT AUTHORITY, ALLAHABAD, a body corporate under President’s Act No. 11 of 1973 enacted in the twenty-fifth year of the Republic of India (hereinafter called the “Vendor,” which expression shall include its successors) of the one part, and SMT. PRIYA VERMA, W/o Rajesh Verma, R/o House No. 12, Lendi Baugh Complex, Near Sub-Registrar Office, Kurnool – 518 003, Pargana and Tehsil Nasibpur Bakhtiyara, Allahabad, L/A C/o Rajesh Verma, R/o LandMark Consultancy Services, Lendi Baugh Complex, Near Sub-Registrar Office, Kurnool – 518 003, Distt. Kurnool through registered power of attorney executed by SMT. PRIYA VERMA, W/o Rajesh Verma, R/o LandMark Consultancy Services, Lendi Baugh Complex, Near Sub-Registrar Office, Kurnool – 518 003, Distt. Kurnool, which has been registered in the office of Sub-Registrar Allahabad on Bahi No. 45, Jild No. 12, Page No. 150 to 155, Sri. No. 3456, hereinafter called the “Vendee,” which expression shall include her heirs, executors, and assigns, of the other part.
WHEREAS the said Vendor has constructed residential flats for persons of the LOWER INCOME GROUP at Sulem Sarai Housing Scheme, Allahabad, and now owns the said flat with absolute power of disposal over the same.
AND WHEREAS the aforesaid flat has been constructed under the LOWER INCOME GROUP scheme for persons qualifying to purchase at a lump sum full price amounting to Rs. 8,00,000 under the said scheme.
AND WHEREAS Smt. Priya Verma is qualified to get one of these flats and has applied for Flat L.I.G. Type II, Flat No. 3, Block No. 5, Sulem Sarai Housing Scheme, Allahabad, in whose favour the aforesaid flat was allotted vide Secretary Order dated 01st March 2025, and the Vendor, being satisfied that the said Vendee fulfills the conditions for acquiring the flat, sanctioned the allotment.
AND WHEREAS the Vendee has paid the Vendor the full sale price of Rs. 8,00,000 (Rupees Eight Lakhs Only), and the Vendor has put the original allottee in full possession thereof with effect from 1st April 2025. The Vendee now desires the requisite sale deed to be executed in her favour on the terms and conditions of the said scheme, a copy of which has been obtained by her.
AND WHEREAS the Vendee has further agreed to bear the entire expenses of conveyance and registration of the sale deed by the Vendor in her favour and has agreed to take the lease of the site of the said flat on the usual terms and conditions of lease for ninety years from the date of possession on prescribed lease rent.
AND WHEREAS the Allahabad Development Authority has sanctioned the transfer of the said flat in favour of the Vendee.
NOW THIS INDENTURE WITNESSETH that in consideration of the sum of Rs. 8,00,000 paid by the Vendee to the Vendor, the receipt whereof the Vendor hereby acknowledges, subject to the conditions of the LOWER INCOME GROUP HOUSING SCHEME for the built-up flats, the Vendor hereby transfers, conveys and assigns unto the Vendee all the hereditaments and premises comprising L.I.G. Type II, Flat No. 3, Block No. 5, Sulem Sarai Housing Scheme, Allahabad, constructed approximately on 90 square meters (covered area).
Any difference in the final calculation of the cost will be payable by either party as required. It is made clear in this Lease Deed/Sale Deed that if the cost of land increases due to compensation awarded by the Judge under referenced cases, the allottees shall be bound to pay the cost of the land accordingly. In case of failure to pay the cost, the same shall be recoverable as arrears of land revenue, along with interest. Any dispute regarding registration, allotment, possession, development, and construction shall be subject to the jurisdiction of the Civil Court at Allahabad.
