STANDARD FORM OF AGREEMENT BETWEEN GOVERNMENT AND CONTRACTOR

This Deed of Agreement is made on this 4th day of June, 2025, at Lucknow, between:

Mr. Rakesh Verma, aged 35 years, son of Mr. Rajendra Verma, resident of Alam Bagh, Lucknow, (hereinafter called the “Contractor”, which expression shall, where the context so admits or implies, be deemed to include his heirs, executors, administrators, and assigns) of the first part;

AND

The Government of Uttar Pradesh, acting through the Governor of Uttar Pradesh (hereinafter called the “Governor”, which expression shall, where the context so admits or implies, be deemed to include his successors-in-office and assigns) of the second part.

WHEREAS:

The Governor requires the execution of certain civil works for construction of a Public Health Centre at Gomti Nagar, Lucknow (hereinafter referred to as the “said work”), as more particularly described in the drawings, specifications, and schedule of rates hereto annexed.

The Contractor has submitted a tender for the execution of the said work, including the provision of necessary materials, and the Governor has accepted the tender subject to the provisions and conditions attached hereto.

NOW THIS DEED WITNESSETH AS FOLLOWS:

  1. In consideration of the payments to be made by the Governor, the Contractor hereby covenants and agrees to:
    • Supply all necessary materials;
    • Execute and complete the said works in a thoroughly sound and workmanlike manner;
    • Maintain the completed works for the defect liability period of 12 months following completion;
    • Comply fully with the drawings, specifications, schedule of rates, and all the terms and conditions attached and signed by both parties.
  2. In return, the Governor hereby covenants with the Contractor to:
    • Pay for the execution, completion, and maintenance of the work as per the agreed rates given in the Schedule of Rates;
    • Make such payments in the manner, at the times, and subject to the additions or deductions as specified in the attached conditions.
  3. It is further agreed that all the provisions contained in the conditions, drawings, specifications, and schedule of rates marked as Annexure-A, attached hereto, shall be binding on both the Contractor and the Governor, and shall be read and construed as part and parcel of this Agreement.

IN WITNESS WHEREOF:

The parties hereto have signed, sealed, and delivered this Agreement on the day, month, and year first above written, in the presence of the undersigned witnesses.
